Terms of Use

1. Agreement

These terms are between you and Makai Technologies, Inc. ("Makai," "we," "us"), a Florida corporation, and they apply when you play Cibola. They sit alongside our company terms of use; where the two conflict about Cibola, this page governs. Apple's standard licence terms also apply to the copy you obtained from the App Store, and where Apple's rules conflict with ours, Apple's govern that purchase.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to play Cibola on devices you own or control, for your own non-commercial entertainment. We keep ownership of the game. You are not permitted to reverse engineer it, resell it, or redistribute its contents.

3. What the game costs

Every one of the 1,000 levels is free. No chapter is locked behind a payment. What you can buy is convenience and quiet:

• Gold, a consumable currency, in three bundle sizes.
• Lives refills and extra moves, consumables.
• Remove Ads, a one-time purchase that permanently removes advertising.

Prices are shown in your local currency before you confirm, by Apple. Purchases are charged to your Apple Account.

4. Gold and other virtual items

Gold, tools and lives are a limited licence to use a feature of the game. They are not money, not property, and not a cryptocurrency or token of any kind. They have no cash value, cannot be exchanged for money or for anything outside Cibola, and cannot be sold, gifted or transferred to another person or account.

Unused gold is forfeited if you delete the game, and does not travel to another device. We may adjust prices, payouts and balances in future updates as the game is tuned; we will not remove gold you have already bought without offering equivalent value.

5. Refunds

Refunds are Apple's to grant, not ours. Request one at reportaproblem.apple.com. We can restore a non-consumable purchase such as Remove Ads at any time from the Vault; consumables that have already been spent cannot be restored.

6. Advertising

The free game shows adverts between levels and offers optional rewarded videos. Buying Remove Ads ends the interstitials permanently. We do not control the content of third-party adverts; complaints about a specific advert should go to support and we will report it.

7. Fair play

Do not modify the game, tamper with its save file, use automation to play it, or attempt to obtain gold or purchases without paying for them. We may reset progress obtained that way.

8. Availability

We may update, change or discontinue Cibola. If we discontinue it entirely, the copy on your device keeps working for as long as your operating system supports it, but we cannot promise indefinite support.

9. No warranty, and our liability

Cibola is provided "as is." To the fullest extent the law allows we disclaim implied warranties, and our total liability to you for any claim relating to the game is limited to what you actually paid us for it in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

10. Governing law

Florida law governs these terms, without regard to its conflict of laws rules, and the state and federal courts in Florida have exclusive jurisdiction. If you live somewhere whose consumer law gives you rights that cannot be waived, this clause does not take them away.
